Over 30% of mesothelioma claims come from veterans each year. This rare cancer occurs due to asbestos exposure. It affects veterans disproportionately due to the prevalent use of asbestos in military ships, barracks, and equipment between 1930 and 1980.

If you or your loved one has been diagnosed with this illness, it is important to understand the legal options available. Veterans may be eligible for benefits from the VA, file claims against asbestos manufacturers, or trust funds. Keep reading to discover the legal options for veterans.

The Link Between Mesothelioma and Veterans

Ex-servicemembers often face higher risks of developing mesothelioma due to the widespread use of asbestos on military bases, ships, vehicles, submarines, and aircraft. Asbestos’s heat-resistant qualities made it preferred for use in insulation and shipbuilding.

At the end of their service, many veterans moved into the construction and manufacturing industries, where they could also be exposed to asbestos. Others who became first responders, such as firefighters and police officers, also faced high risks of exposure. However, most veterans who suffered exposure ended up with Epithelioid Mesothelioma, the most common type.

If you’re a veteran diagnosed with mesothelioma, you may consider applying for veterans’ benefits through the Veterans Affairs (VA) Department. You may also be eligible for legal action against the companies liable for your asbestos exposure and illness. Veteran pathways can also support those looking to retrain or pursue new careers after service, especially for individuals whose diagnosis may limit previous job options.

Filing a Mesothelioma Claim as a Veteran

Veterans who have developed mesothelioma due to asbestos exposure during their military service are entitled to financial compensation. These veterans can apply for VA disability benefits, which include healthcare services and monetary support.

This process involves providing proof that the victim was exposed to asbestos during their military service. Medical records and evidence of exposure must back these claims to be valid.

In addition to VA benefits, affected veterans can file legal claims against asbestos product manufacturers or suppliers. Veterans do not file legal action against the U.S. military, which is not considered liable. However, the statute of limitations applies in this case.

The Compensation Options for Veterans with Mesothelioma

Veterans who have been diagnosed with mesothelioma have several compensation options to cover their medical expenses and financial needs. Besides the benefits from the VA, settlements from legal claims offer extra financial relief. Here are the options.

VA Healthcare

Veterans suffering from mesothelioma will receive healthcare provision from the VA if 50% of their asbestos exposure occurred during active duty. In this situation, there must be proof that the illness is linked to your service.

Disability Compensation

Disability compensation includes monthly support for veterans with mesothelioma, depending on the severity of their disability. Mesothelioma is considered 100% disabling, and veterans receive different amounts determined by their number of dependents.

Special Monthly Compensation

Veterans who have been disabled due to mesothelioma and need assistance from others may receive special monthly compensations. These benefits may also be available for the parents and spouses of victims.

Personal Injury Settlements

Settlements from legal claims, such as personal injury claims, provide extra financial relief by holding asbestos manufacturers and suppliers accountable. Veterans may also receive compensation through asbestos trust funds established by liable bankrupt companies. Hiring a mesothelioma lawyer can help maximize your settlement.

Endnote

Veterans who have been diagnosed with asbestos have several legal options and are eligible for several benefits. For instance, they may qualify for VA healthcare benefits, disability compensation, personal injury settlements, and special monthly compensation.
